Fireworks Information

On April 30, 2002 Minnesota made it legal to possess, sell and use some types of fireworks. Minnesota was quite selective in which fireworks were going to be allowed.

Examples of legal fireworks according to Minnesota Statute 624.20 ( c ) include:

  • Wire or wood sparklers of not more than 100 grams of mixture per item
  • Other sparkling items which are nonexplosive and nonaerial and contain 75 grams or less of chemical mixture per tube or a total of 200 grams or less for multiple tubes

Novelty items such as snakes and glow worms, smoke devices, or trick noisemakers such as paper streamer, party poppers, string poppers, snappers and drop pops, each consisting of not more than .025 grains of explosive mixture are also legal.

Examples of fireworks that are illegal to use, sell or possess include:

  • Any fireworks that are explosive
  • Any fireworks that are aerial

Fire crackers
Lady fingers
Sky rockets
Bottle rockets
Missile rockets
Helicopter, aerial spinners, planes, UFOs
Roman candles
Chasers
Parachutes
Aerial shells

Any fireworks listed above are illegal to possess, sell or use unless you have a permit asd a certified operator according to Minnesota Statute 624.20.

624.25 Violation

If the violation involves any amount of fireworks other than explosive fireworks, you can be fined up to 90 days in jail and a fine of not more than $700 or both.

If the violation involves explosive fireworks in an amount of less than 35 pounds gross container weight, you can be imprisoned for not more than 90 days or fined no more than $700 or both.

If the violation involves explosive fireworks in an amount of 35 pounds gross container weight or more, you can be imprisoned for not more than one year or fined no more than $3,000 or both.
